Introduction

Elite Digital Technologies LLC (“we,” “us,” or “our”) operates the ROAI platform at getroai.ai and app.getroai.ai (collectively, the “Service”). This Privacy Policy explains how we collect, use, disclose, retain, and protect information about you when you use the Service, and describes your rights with respect to that information.

The ROAI platform is built on technology developed and maintained by Elite Digital Technologies LLC as our backend technology provider. Elite Digital Technologies LLC processes data on our behalf as a service provider and is identified as a subprocessor in Section 8 of this Policy.

Elite Digital Technologies LLC operates and maintains the ROAI platform and processes Customer Data solely for the purpose of providing, operating, maintaining, securing, and supporting the Service, in accordance with customer instructions and applicable law.

We are committed to protecting your privacy in accordance with applicable United States federal and state privacy laws and industry-standard privacy and security practices.

1. Definitions

“Controller” means the entity that determines the purposes and means of processing Personal Data. For Personal Data collected directly by Elite Digital Technologies LLC in connection with operating, administering, securing, supporting, and marketing the Service, Elite Digital Technologies LLC acts as the Controller. For Customer Data uploaded, connected, or otherwise provided by customers through the Service, customers act as the Controller, Business, or equivalent entity under applicable law, and Elite Digital Technologies LLC acts solely as a service provider, processor, or contractor, as applicable under relevant law.

“Customer Data” means all data you upload, connect, or otherwise provide to the Service, including data imported from third-party platforms such as HubSpot and QuickBooks.

“Personal Data” or “Personal Information” means any information that relates to, identifies, or could reasonably be used to identify a natural person, directly or indirectly. The terms are used interchangeably in this Policy.

“Processor” means an entity that processes Personal Data on behalf of a Controller. With respect to Customer Data processed through the Service, Elite Digital Technologies LLC acts solely as a service provider, processor, or contractor on behalf of its customers. Third-party sub processors identified in Section 8 may process Personal Data on behalf of Elite Digital Technologies LLC in connection with providing the Service.

“Sensitive Personal Information” means Personal Data revealing racial or ethnic origin, religious beliefs, health or medical information, sex life or sexual orientation, immigration status, financial account credentials, precise geolocation, biometric information, or personal communications.

“Service” means the ROAI platform and all related websites, applications, and services operated by  Elite Digital Technologies LLC.

“Usage Data” means data collected automatically through your use of the Service, including IP addresses, browser type, device identifiers, pages visited, time spent, and other diagnostic or analytics data.

2. Information We Collect

2.1 Information You Provide

We collect information you provide directly when you create an account, purchase a subscription, contact us for support, or otherwise interact with the Service. This includes:

(a) Identity information: first name, last name, and email address;

(b) Contact information: phone number, company name, and company size;

(c) Account credentials: username and password (stored in encrypted form);

(d) Billing information: payment card details and billing address (processed by our payment processor; we do not store full card numbers); and

(e) Communications: messages, feedback, and support requests you send us.

2.2 Customer Data from Third-Party Platforms

When you connect a third-party platform such as HubSpot or QuickBooks, the Service accesses and processes data from that platform solely to generate AI Insights for your account. This data may include CRM records (contacts, leads, deals), financial data (invoices, expenses, revenue), and business operational data. As between the customer and Elite Digital Technologies LLC, the customer retains all rights, title, and interests in Customer Data. Elite Digital Technologies LLC acquires no ownership rights in Customer Data except the limited rights necessary to provide and support the Service. Customers are solely responsible for determining the purposes and lawful basis for processing Customer Data and for obtaining any required notices, consents, authorizations, or permissions necessary to provide Customer Data to the Service. We do not use it for advertising, and we do not sell it.

2.3 Usage Data

We automatically collect Usage Data when you access and use the Service. This includes your IP address, browser type and version, operating system, device identifiers, pages and features accessed, time and duration of visits, referring URLs, and other diagnostic data. We use this data to operate, maintain, and improve the Service.

2.4  Cookies and Tracking Technologies

We use cookies and similar tracking technologies as described in our Cookie and Opt-Out Policy at getroai.ai/opt-out-preferences/. You can manage your cookie preferences at any time by visiting that page or contacting us at support@getroai.ai. The following categories of cookies are used:

Functional/Essential: Required to operate the Service. These cannot be disabled.

Analytics/Statistics: Used to understand how users interact with the Service. Google Analytics is currently deployed. You may opt out via the Cookie Policy page.

Marketing/Advertising: Used to serve relevant advertising.

2.5  Information from Other Sources

We may receive information about you from third parties, such as analytics providers or advertising partners, and combine it with information we hold about you. We will treat that combined information in accordance with this Privacy Policy.

3. How We Use Your Information

We use the information we collect for the following purposes:

(a) Providing and maintaining the Service: to operate, deliver, maintain, and improve the Service, including generating AI Insights from your Customer Data.

(b) Account management: to create and manage your account, authenticate your identity, and provide you access to features of the Service.

(c) Processing payments: to process your subscription fees and manage billing.

(d) Communications: to send you service notifications, security alerts, product updates, and marketing communications where you have consented or where we have a legitimate interest. You may opt out of marketing communications at any time.

(e) Customer support: to respond to your inquiries and resolve issues.

(f) Safety and security: to detect, investigate, and prevent fraud, abuse, unauthorized access, and other unlawful activity.

(g) Legal compliance: to comply with applicable laws, regulations, legal process, and governmental requests.

(h) Business transfers: in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets, subject to the buyer assuming our privacy obligations.

(i) Analytics and improvement: to analyze usage trends, measure the effectiveness of our features, and improve the Service.

4. How We Share Your Information

4.1 We Do Not Sell Your Personal Information

Elite Digital Technologies LLC does not sell Personal Information as that term is commonly understood. However, certain disclosures to advertising and analytics partners may constitute a “sale” or “sharing” under the CCPA/CPRA and similar state laws. You have the right to opt out of such disclosures. See Section 7 (Your Privacy Rights) for instructions.

4.2 Service Providers and Sub processors

We engage third-party service providers and sub processors to assist in providing, operating, maintaining, securing, and supporting the Service. We conduct commercially reasonable diligence when selecting sub processors and require them, where appropriate, to maintain confidentiality, privacy, and security obligations consistent with applicable law and industry practices. However, Elite Digital Technologies LLC does not guarantee the acts, omissions, or independent security practices of third-party service providers. Our current sub processors are identified in Section 8.

4.3 Technology Provider

Elite Digital Technologies LLC has access to Customer Data and Personal Data as our backend technology provider. Elite Digital Technologies LLC processes data solely to operate, maintain, and secure the ROAI platform on our behalf and is bound by obligations consistent with this Privacy Policy.

4.4 Business Transfers

If Elite Digital Technologies LLC is involved in a merger, acquisition, financing, or sale of all or substantially all of its assets, your Personal Data may be transferred as part of that transaction. In the event of a merger, acquisition, financing, restructuring, or sale of assets, Personal Data may be transferred as part of the transaction, subject to applicable law and commercially reasonable notice obligations.

4.5 Legal Requirements

We may disclose your Personal Data where required by law, court order, or governmental authority, or where we reasonably believe disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; (c) prevent or investigate wrongdoing in connection with the Service; (d) protect the personal safety of users or the public; or (e) protect against legal liability.

4.6 With Your Consent

We may share your Personal Data for any other purpose with your explicit consent.

5.  Data Retention

We retain Personal Data for as long as necessary to provide the Service and for the additional periods described below. When determining retention periods, we consider the amount and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the data, and applicable legal requirements.

You may request deletion of your Personal Data at any time by contacting support@getroai.ai. We will use commercially reasonable efforts to process verified deletion requests within the time periods required by applicable law, subject to technical limitations, backup retention schedules, and legal obligations. Upon termination of your subscription, Customer Data handling follows the schedule above.

6.  International Data Transfers

6.1  US-Based Hosting

The Service is hosted on Microsoft Azure cloud infrastructure located in the United States. If you access the Service from outside the United States, your Personal Data will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

Where we transfer Personal Data internationally, we take steps to ensure that appropriate safeguards are in place to protect your information consistent with this Privacy Policy and applicable law.

7.  Your Privacy Rights

7.1  Rights Available to All Users

Regardless of your location, you have the following rights with respect to your Personal Data:

Access: You may request a copy of the Personal Data we hold about you.

Correction: You may request that we correct inaccurate or incomplete Personal Data.

Deletion: You may request that we delete your Personal Data, subject to legal retention obligations.

Portability: You may request your Personal Data in a structured, commonly used, machine-readable format.

Opt-out of marketing: You may opt out of marketing communications at any time by clicking the unsubscribe link in any email or contacting support@getroai.ai.

7.2 California Residents (CCPA/CPRA)

If you are a California resident, you have the following additional rights under the CCPA/CPRA:

Right to Know: To request disclosure of the categories and specific pieces of Personal Information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it.

Right to Delete: To request deletion of Personal Information we have collected, subject to exceptions.

Right to Correct: To request correction of inaccurate Personal Information.

Right to Opt Out of Sale/Sharing: To direct us not to sell or share your Personal Information. To exercise this right, visit getroai.ai/opt-out-preferences/ or contact support@getroai.ai.

Right to Limit Use of Sensitive Personal Information: To limit our use of Sensitive Personal Information to what is necessary to provide the Service.

Right Not to be Discriminated Against: We will not discriminate against you for exercising any CCPA/CPRA rights.

7.3 New Jersey Residents (NJDPL)

If you are a New Jersey resident, you have the following rights under the New Jersey Data Privacy Law (effective January 15, 2025): the right to access, correct, delete, and obtain a portable copy of your Personal Data; the right to opt out of the processing of your Personal Data for purposes of targeted advertising, sale, or profiling; and the right to appeal a denial of your request. 7.4 Other US State Residents

Residents of Colorado, Connecticut, Virginia, Texas, Oregon, Montana, Iowa, Delaware, New Hampshire, Nebraska, and other states with comprehensive privacy laws have rights similar to those described above, including rights to access, correct, delete, and opt out of the sale or sharing of Personal Data. Right to withdraw consent: Where processing is based on consent, to withdraw that consent at any time without affecting prior lawful processing.

We may need to verify your identity before processing your request. We will not charge a fee for reasonable requests and will not discriminate against you for exercising your rights. We respond to requests within the timeframes required by applicable law.

8.  Subprocessors and Third-Party Services

The following third parties process Personal Data on our behalf as subprocessors. We require each subprocessor to maintain appropriate security measures and to process data only as instructed.

We do not authorize any subprocessor to use Personal Data for their own marketing or advertising purposes. We will update this list when we add or remove subprocessors and will provide notice to users where required by applicable law.

9.  Security

Elite Digital Technologies LLC implements commercially reasonable administrative, technical, and organizational safeguards designed to protect Personal Data consistent with applicable law and industry practices. These measures include:

Infrastructure: The Service is hosted on Microsoft Azure cloud infrastructure with industry-standard physical and network security controls.

Tenant isolation: Logical separation of customer tenants and access controls prevent cross-tenant data access.

Encryption: Data in transit is protected using TLS/HTTPS. Data at rest is encrypted in databases, storage, and backups.

Access control: Role-based access control (RBAC) and least-privilege administration limit access to Personal Data to authorized personnel only.

Audit logging: Administrative actions, integration changes, data exports, and authentication events are logged and monitored.

Backups: Encrypted backups are maintained with defined retention and recovery procedures.

No security system is 100% secure. We cannot guarantee the absolute security of your Personal Data. In the event of a security incident affecting your Personal Data, we will notify you as required by applicable law. Under the New Jersey breach notification statute, we aim to provide notice within 72 hours of confirming a breach. While we implement commercially reasonable administrative, technical, and organizational safeguards, Elite Digital Technologies LLC does not warrant or guarantee that the Service or any data transmission or storage system will be completely secure, uninterrupted, or error-free.

AI-generated insights, recommendations, analytics, summaries, predictions, and outputs provided through the Service are generated automatically and are provided for informational and business support purposes only. Elite Digital Technologies LLC makes no representations or warranties regarding the accuracy, completeness, reliability, suitability, or fitness of any AI-generated output for any particular purpose. Customers are solely responsible for reviewing, validating, and relying upon any output generated by the Service.

Customers are solely responsible for the accuracy, legality, completeness, quality, and authorization of all Customer Data submitted to or processed through the Service. Elite Digital Technologies LLC shall have no responsibility or liability arising from inaccurate, incomplete, unauthorized, or unlawful Customer Data provided by customers or third-party integrations.

To the maximum extent permitted by applicable law, Elite Digital Technologies LLC shall not be liable for unauthorized access, disclosure, alteration, loss, or destruction of Customer Data resulting from events beyond its reasonable control, including cyberattacks, internet failures, acts of third-party service providers, force majeure events, or customer security failures.

Limitation of Liability

To the maximum extent permitted by applicable law, the aggregate liability of Elite Digital Technologies LLC arising out of or relating to the Service, the processing of Personal Data, Customer Data, AI-generated outputs, or this Privacy Policy shall not exceed the total fees paid by the customer to Elite Digital Technologies LLC during the twelve (12) months immediately preceding the event giving rise to the claim.

10.1 Categories of Data Subjects and Personal Data

We process Personal Data of the following categories of data subjects: registered users of the Service (business professionals and account holders), and individuals whose data is contained in Customer Data connected through third-party integrations (e.g., contacts, leads, and customers in a user’s HubSpot or QuickBooks account).

Categories of Personal Data processed include: identifiers (name, email, IP address); account credentials; commercial information (subscription and payment records); internet activity (usage and interaction data); and business data contained in Customer Data.

Automated Decision-Making

The Service uses AI to generate insights and analytics based on your Customer Data. This AI processing does not constitute automated decision-making that produces legal effects concerning you or similarly significantly affects. AI Insights are provided as decision-support tools only. Final decisions are always made by human users.

11.  Children’s Privacy

The Service is not directed to individuals under the age of 16 (or the applicable age of digital consent in your jurisdiction). We do not knowingly collect Personal Data from anyone under 16. If you are a parent or guardian and believe your child has provided us with Personal Data, please contact us at support@getroai.ai and we will delete that information promptly

12.  Third-Party Links and Services

The Service may contain links to or integrations with third-party websites, services, and applications that are not operated by us. We are not responsible for the privacy practices or content of those third parties. We strongly encourage you to review the privacy policies of any third-party service you access through or in connection with the Service. Our Privacy Policy applies only to the Service.

13.  Do Not Track

Our Service does not currently respond to Do Not Track (DNT) signals from browsers. However, you can manage your cookie preferences and opt out of certain tracking through our Cookie and Opt-Out Policy page at getroai.ai/opt-out-preferences/.

14.  Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by: (a) posting the updated Policy on the website with an updated effective date; (b) sending an email notice to the address associated with your account where practicable; and (c) for material changes that significantly affect USA users’ rights, providing at least 30 days’ advance notice. Your continued use of the Service after the effective date of the updated Policy constitutes acceptance. If you do not agree to the updated Policy, you must stop using the Service.

15. Cybersecurity Liability Limitation

To the maximum extent permitted by applicable law, Elite Digital Technologies LLC shall not be liable for unauthorized access, disclosure, alteration, loss, or destruction of Customer Data resulting from events beyond its reasonable control, including cyberattacks, internet failures, acts of third-party service providers, force majeure events, or customer security failures.
